Sleep Better

Terms of Service

Last updated: October 19, 2026

1. Acceptance of these Terms

These Terms of Service ("Terms") apply to the Sleep Better: Sounds & Coach app for iPhone and iPad (the "App") and the website at sleepbetter.ai (the "Site"), together the "Service". The Service is operated by Daniel Gnecco ("we", "our" or "us"). By downloading, installing or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

2. Apple's Standard EULA

The App is licensed to you, not sold, under Apple's Licensed Application End User License Agreement (the "Standard EULA"), which is the Terms of Use shown on our App Store listing. These Terms add to the Standard EULA. If they conflict on the license to use the App, the Standard EULA controls. Apple is not responsible for the App or its content.

3. The Service

Sleep Better helps you wind down and fall asleep with sleep sounds, sleep music, brainwave beats, guided sleep meditations, sleep journeys, whispered affirmations, a sleep coach, and optional Sleep Insights from Apple Health. The Site offers information about sleep sounds and the App. We may add, change or remove features over time.

4. Free version and Premium

The App is free to download. The free version includes a selection of features and content. Premium is an optional auto-renewing subscription that unlocks everything, including unlimited AI coaching.

5. The Coach and AI-generated content

The Coach and other AI features generate responses automatically. AI-generated content can be inaccurate, incomplete or unsuited to your situation. It is general wellness information, not medical, psychological or other professional advice. Don't rely on it for decisions about your health. Please don't enter sensitive personal information, and don't use AI features for anything unlawful or harmful. How Coach messages are handled is explained in our Privacy Policy.

6. Health disclaimer

The Service is for general wellness and relaxation only. It is not a medical device, and it does not provide medical advice, diagnosis or treatment. Talk to a qualified healthcare professional about any medical condition or sleep disorder, and never ignore or delay professional advice because of something in the Service. Don't use sleep sounds, brainwave beats or meditations while driving, operating machinery, or in any other situation that needs your full attention. Keep the volume at a comfortable, safe level, especially with headphones.

7. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or guardian has agreed to these Terms for you.

8. Acceptable use

You agree not to:

9. Intellectual property

The Service and its content, including sounds, music, voice recordings, text, graphics, logos and software, belong to us or our licensors and are protected by intellectual property laws. Subject to these Terms and the Standard EULA, you may use the Service for your own personal, non-commercial use. You may not reproduce, distribute, publicly perform or create derivative works from it without our written permission.

10. Your content

You keep ownership of what you enter into the Service, such as Coach messages, check-ins and wind-down plans ("Your Content"). You give us a limited, non-exclusive, royalty-free license to use Your Content only to provide and improve the Service for you. We won't sell Your Content or use it for advertising. See our Privacy Policy.

11. Third-party services

The Service works with third-party services such as Apple Health, the App Store and YouTube. Their own terms and privacy policies apply to how you use them, and we are not responsible for them.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted, error-free or free of harmful components, or that it will improve your sleep.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of or inability to use the Service, even if we were told such damages were possible. Some places don't allow these limits, so they may not all apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

14. Ending your use

You can stop using the Service at any time by deleting the App and cancelling any subscription in your Apple Account settings. We may suspend or end access for anyone who seriously or repeatedly breaks these Terms.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. If a change is material, we will tell you in the App or on this page before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules, except where the law of the place you live requires otherwise.
